Welcome to Cyber LMS. These Terms of Service ("Terms") govern your access to and use of the Cyber LMS website, platform, courses, and services (collectively, the "Service") operated by Vici Tech Solutions LLC ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service ("Users", "you", or "your").

To use the Service, you must:

• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Notify us immediately of any unauthorized access to your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your login credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users.

4.1 Subscription Plans

Cyber LMS offers subscription-based access to premium content and features. Details of available plans, pricing, and features are available on our Pricing page.

4.2 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Payment is processed securely through Stripe
• All prices are displayed in the currency indicated at checkout
• Prices are inclusive of applicable VAT/taxes where required

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings or by contacting support.

4.4 Refunds

Refund requests are handled on a case-by-case basis. Generally:

• Refunds may be available within 14 days of initial purchase if you have not substantially used the Service
• No refunds are provided for partial subscription periods

4.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply from your next billing cycle.

You agree NOT to:

• Share your account credentials with others
• Access or use another user's account
• Copy, reproduce, distribute, or create derivative works from our content without authorization
• Use automated tools (bots, scrapers, etc.) to access the Service
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Upload malicious code or content
• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Use the knowledge gained from our cybersecurity courses for malicious purposes

6.1 Our Content

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Vici Tech Solutions LLC and its licensors. This includes but is not limited to:

• Course materials, videos, and presentations
• Quizzes, assessments, and lab environments
• Text, graphics, logos, and images
• Software, code, and algorithms
• Trademarks, service marks, and trade names

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes. This license does not include:

• The right to resell or redistribute our content
• The right to modify or create derivative works
• The right to publicly display or perform our content
• The right to use our content for commercial training purposes

6.3 Certificates

Certificates issued upon course completion are for personal use and professional development. They may not be altered, forged, or misrepresented.

If you submit, post, or display any content through the Service (e.g., forum posts, comments, quiz submissions):

• You retain ownership of your content
• You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Service
• You represent that you have all necessary rights to the content you submit
• You agree not to submit content that is illegal, offensive, or violates third-party rights

We reserve the right to remove any content that violates these Terms or that we deem inappropriate.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of content
• Warranties that defects will be corrected

Educational Content Disclaimer

Our courses are designed for educational purposes. While we strive to provide accurate and up-to-date information, the cybersecurity field evolves rapidly. We do not guarantee that completing our courses will result in:

• Passing any certification exam
• Employment or career advancement
• Complete protection against cyber threats

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VICI TECH SOLUTIONS LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar issues transmitted through the Service

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Vici Tech Solutions LLC and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service
• Your misuse of knowledge or skills gained from our courses

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

11.3 Consumer Rights

If you are a consumer, nothing in these Terms affects your statutory rights under applicable consumer protection laws.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will:

• Provide at least 30 days' notice before the new terms take effect
• Notify you via email and/or a prominent notice on our website
• Update the "Last updated" date at the top of these Terms

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

13.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

13.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.3 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cyber LMS regarding the Service.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
